Fourteen-day withdrawal
Consumers may withdraw without giving a reason within 14 days of receiving goods themselves or through a designated third party other than the carrier. For multiple goods ordered together and delivered separately, the statutory cases use receipt of the last item. Submit the online withdrawal form, email info@lunaticstore.it, PEC francescafuso@postecert.it or another clear declaration to the seller. The form is optional. Sending before the deadline is sufficient; withdrawal may also be exercised before delivery and does not require the seller's permission.
Returning goods and costs
Send or hand over goods without undue delay and within 14 days of notifying withdrawal. Sending within that period meets the deadline. Return address: LUNATIC VINTAGE DI FRANCESCA FUSO, Viale di Monte Tondo 7, 00072 Ariccia (RM), Italy.
For change-of-mind returns, you bear direct return costs. Choose and pay your own carrier: no LUNATIC return-service deduction is made. If you request a label or collection arranged by us, availability and price must first be verified with the carrier and expressly accepted by you. Only that agreed cost may be deducted. Unconfirmed return tariffs never apply automatically.
Package the item suitably. You may inspect it as you would in a shop; you are responsible only for diminished value caused by handling beyond what is necessary to establish nature, characteristics and functioning. Original packaging helps transport but its absence does not automatically remove withdrawal rights.
Refunds
We refund payments without undue delay and within 14 days of withdrawal notification. Unless we offered to collect the goods, we may withhold reimbursement until receiving the goods or evidence of their return, whichever happens first. Warehouse receipt is therefore not the only possible trigger.
For total withdrawal, standard original delivery charges are also refunded; the extra cost of a more expensive delivery option chosen by you need not be refunded. For partial withdrawal, the portion of original shipping attributable to returned goods is refunded, but charges that would have remained identical for retained goods are not. We do not automatically impose penalties or retroactive delivery charges for losing a promotional threshold.
Refunds use the original payment method unless you expressly agree otherwise without costs to you. Cash-on-delivery refunds require an agreed traceable method, such as bank transfer, with only necessary details collected through support. Do not email card details.
Custom goods
Article 59(1)(c) of the Italian Consumer Code excludes change-of-mind withdrawal for made-to-specification or clearly personalised goods. Producing a standard item after ordering does not automatically make it personalised. Draft approval confirms specifications and starts production; approval alone does not create the statutory exception, which depends on the nature of the goods. The exception must be disclosed before purchase on the relevant product page. Conformity rights always remain.
Legal conformity guarantee
The seller is responsible for conformity defects appearing within two years of delivery under Articles 128 onwards of the Italian Consumer Code. Used goods sold to consumers are also covered: without a specific valid agreement for a lawful shorter period, the ordinary two-year term applies. LUNATIC does not impose an automatic vintage reduction here.
Statutory remedies include repair or replacement free of charge, subject to legal feasibility and proportionality rules, and price reduction or termination in the cases provided by law. Remedies must be performed within a reasonable time without significant inconvenience. Defects appearing within one year benefit from the statutory presumption of pre-existence unless incompatible with the goods or defect. No return costs contrary to guarantee rights are charged. Normal wear and specifically disclosed and accepted vintage characteristics are assessed under the law; the vintage label does not eliminate the guarantee. Model withdrawal declaration
To the seller at the address/email above: “I hereby withdraw from the sales contract for the following goods …; ordered on … / received on …; consumer name …; consumer address …; date …; signature, only for a paper declaration.” This model is optional.
